INCENTIVE REGISTRATION ELIGIBILITY

Only individuals that registered for 2022 NBS Summit or 2021 NBS Virtual Summit are eligible for incentive registration. If your registration was transferred, you are not eligible for incentive registration. Ineligible individuals that register through incentive registration can receive only a 50% refund or pay the $50.00 additional amount for Early Registration and a $50.00 change fee.

INDIVIDUAL CANCELLATIONS

All requests for changes, cancellations or refunds must be made in writing to the trip leader.

Registration & club fees are non-refundable, except as outlined above for those that sign up for incentive registration without having proper eligibility.

Epic pass purchases are non-refundable

ADDITIONAL DEPOSITS AND CANCELLATION POLICIES FOR LODGING AND OTHER PURCHASES

At this time we do not know the lodges and other components that the club will elect to offer its participants. Once the club elects lodges and other components, we will add the terms and conditions under which those components can be purchased.

LATE PAYMENTS: If SKI.com does not receive payments in a timely manner from the individual club, the entire booking for said individual club may be cancelled and/or late fees of $100 plus supplier-imposed fees may be assessed against the individual club to cover necessary expedited mailing fees and other costs. This policy is in place to meet obligations to vendors supplying the components of your trip. Airlines may automatically cancel seats if tickets are not issued and paid for by the required dates. Lodging companies may charge late fees or cancel reservations if they are not paid on time.

CHANGE FEES

After the 1st change to a reservation or service, each subsequent change will incur a $50 change fee. If change is for additional services or upgrades to a reservation no fee will be incurred.

If changes are for Airline or Ground transportation, those fees will be advised at the time of request for the service and may be higher than $50.

CONFIDENTIAL/PROPIETARY INFORMATION: Ski.com acknowledges that some of the information provided to Ski.com pursuant to this agreement may consist of Confidential Information. As used in this Agreement, the term "Confidential Information" shall mean (a) proprietary information of the NBS; (b) information marked or designated by the NBS as confidential; (c) information, whether or not in written form and whether or not designated as confidential, which is known to Ski.com as being treated as confidential by the NBS; and (d) information provided to Ski.com by third parties which Ski.com is obligated to keep confidential. Confidential information includes, but is not limited to, discoveries, ideas, designs, specifications, drawings, techniques, models, data, programs, documentation, processes, know-how, customer lists, marketing plans, and financial and technical information. Ski.com agrees that it will not disclose directly or indirectly, under any circumstances or by any means, to any third party and will hold in confidence any and all proprietary information, and other matters owned by the NBS brought to Ski.com's attention (collectively the "Information") by NBS during the course of this Agreement, whether in written, oral or any other form. Without the prior written consent of the NBS, Ski.com agrees not to use the Information for any purpose other than the performance of the Services performed for NBS. However, Ski.com shall not be so restricted where (i) the Information is now or becomes public through no fault of Ski.com, or (ii) Ski.com already had the Information in his/her possession from his/her own work prior to the date of this Agreement, or (iii) Ski.com received the Information from a third party on a non-confidential basis and not derived from NBS, or (iv) Ski.com receives permission in writing from the NBS to disclose the Information. Ski.com hereby acknowledges that the Information is and shall continue to be the exclusive property of the NBS, whether or not disclosed or entrusted to Ski.com pursuant to this Agreement. Upon termination of this Agreement, Ski.com agrees to promptly return to the NBS all of the Information, in whatever form, that Ski.com may then have in its possession or under its control.

Ski.com agrees that it will not copy, transmit, reproduce, summarize, quote, or make any commercial use whatsoever of the NBS's Information without the express written consent of the NBS. Ski.com agrees to exercise the highest degree of care in safeguarding the NBS's Information against loss, theft, or other inadvertent disclosure, and agrees generally to take all steps necessary to ensure the maintenance of confidentiality.

FORCE MAJEURE:

Either party may terminate or suspend its obligations under this agreement to the other party if such obligations are delayed, prevented, or rendered impractical by the occurrence of any of the events listed, including but not limited to: fire, flood, earthquake, hurricane, civil commotion, insurrection, act of God, pandemic, strikes, riot, government action, travel restriction issued by a government agency or as self-imposed due to the COVID-19 pandemic by individual travel carriers (airline, train, bus or car) provided that the party which is unable to perform its obligations provides notice to the other party as promptly as possible following the onset of such events or circumstances. In the event that such force majeure affects the group travel, either party may cancel all outstanding portions of the meeting without incurring any charges. Airline purchases are subject to each carriers’ policies for future credit or refund.

RESPONSIBILITY STATEMENT: The payment of the required deposit or any partial or full payment hereunder shall constitute consent and agreement to the provisions herein. SKI.com, its agents, servants and employees shall not be responsible for personal injuries or property damage, loss or delay, or change of itinerary incurred by any person or tour participant arising out of the act of negligence of any direct or supplemental air carrier, hotel or other persons rendering any of these services, or accommodations offered in these tours; nor shall SKI.com be responsible for any injuries, death, damage, loss or delay in any means of the transportation or by reason of any event beyond the actual control of SKI.com, or of any agent or supplier or due to force majeure. SKI.com reserves the right to decline or accept or to retain any person as a member of a trip, or to cancel a trip. Tour participants shall ski at their own risk. Tour participants acknowledge that they are aware of the fact that skiing and other activities in which they may elect to participate while on the tour involve inherent risks and danger of injury or death. Tour participants shall participate in such activities at their own risk and indemnify and hold SKI.com, their employees and agents harmless in the event of injury or death. If the contract between SKI.com and the participant and/or the contract between SKI.com and the air carrier or vendor is cancelled for any reason whatsoever, all partial or full payments made for the trip will be refunded in their entirety, without further obligation of the part of SKI.com. SKI.com may substitute hotels for other hotels of similar category or change schedules should the circumstance so demand. If time permits, SKI.com will provide notification of any such changes. In the event of a change in the itinerary necessitated by factors or conditions beyond the control of SKI.com, no refund can be made nor will credit be allowed, provided that, in the event of such change in itinerary, SKI.com shall provide accommodations and services of comparable quality and standards. Any such change shall not modify the cancellation provisions herein. No credit will be allowed or refund provided for any services provided in the Itinerary and Conditions List should any such services not be utilized by tour members. Availability of refunds for air transportation included in a tour and additional transportation costs for a person who does not utilize the air transportation part of a tour will vary with the type of transportation, and the point at which transportation is not used. The person signing this document on behalf of the organization does attest that he or she has been empowered by the said Organization to issue and sign contract on behalf of the Organization. If the Organization is not a legal entity, then the person signing is accepting personal responsibility for the items herein. This document is the sole agreement between the parties. Any changes must be in writing and reference this agreement.
